Description of Practice
Mediation expertise in the areas of traditional labor law area and employment litigation. In traditional labor law, has handled issues dealing with wrongful discharge and contractual interpretation issues. In the employment litigation area, has handled issues involving all types of federal and state laws (FMLA, ADA, ADEA, PDA, TITLE VII, ELCRA, PWDA, Whistleblowers, wage and hour, public policy, discrimination, harassment, emotional distress, etc.) Has also mediated general civil matters involving issues between two businesses (breach of contract, embezzlement, exclusive franchise rights), multiple parties (construction, personal injury) and personal property loss and personal injury.
Professional Background
Patricia Nemeth earned both her law degree and her Masters of Labor Law degree from Wayne State University School of Law in 1984 and 1990 respectively. Since 1984, Ms. Nemeth has been specializing in the labor and employment area as a litigator, consultant, negotiator, and more recently as a mediator. She completed the mediation training required under the Michigan Court Rules in 2003, and now serves as a mediator in employment and other types of civil litigation matters. She is a certified mediator with the American Arbitration Association and International Mediation Institute.
Ms. Nemeth is a member of the State Bar of Michigan (Labor and Employment Section and International Law Section), member of the American Bar Association (Labor and Employment Section, Insurance Law Section, and Alternative Dispute Resolution Section). Martindale Hubble rates Ms. Nemeth as “AV”, the highest rating for legal ability and upholding ethics in the legal profession.
In 2010, Ms. Nemeth was named as one of the Best Lawyers in America – Labor and Employment. In 2009, she was named as one of the twenty-five outstanding “Leaders in the Law” by Michigan Lawyer’s Weekly and was honored with Wayne State University’s Most Distinguished Alumni Award. For several years, Ms. Nemeth has been recognized as one of the top 50 Women Super Lawyers. In 2008, she was named by Inforum as one of the 100 most influential women in Southeastern Michigan. In 2006, Ms. Nemeth served as a Labor and Employment Law Delegate to China. She is a graduate of the 2004-2005 Leadership Detroit XXVI Class.
Experience
Cases mediated have covered a wide variety of issues: 25% involved employment litigation issues such as workplace violence and discrimination/harassment. 25% involved traditional labor issues to be resolved under the collective bargaining agreement - terminations and contractual interpretations. The other 50% of the cases mediated involved commercial contracts, construction claims, and claims for personal injury.

Approach
The mediation process is an extremely useful settlement tool for all of us. This was not my opinion when the process first came into vogue some years ago. However, from witnessing the mediation process firsthand and becoming responsible for its successes as a mediator, my opinion has changed. The participating parties are in the best position and have the best insight for determining the type of process which will work best for resolving their dispute (i.e., whether to have a joint session or when such a session would be beneficial during the process). It is my job to creatively guide the parties toward a resolution. No mediation is the same and therefore no approach to the mediation process can be the same. The techniques used depend on the nature of the issues and the parties involved.
Fees
