Description of Practice

Joe Markowitz has more than twenty years experience as a mediator. He is currently a member of the Mediation Panels for both the District Court and Bankruptcy Court in the Central District of California, as well as having served on the mediation panel for the Los Angeles County Superior Court. He was also a member for two years of the Superior Court's ADR committee. He served as President of the Southern California Mediation Association in 2014.
Mr. Markowitz publishes a leading blog called Conflict Resolution, which can be found at mediate-la.com, also frequently syndicated on this site.

Professional Background

Joe Markowitz started his practice with a boutique litigation firm in New York City. He also practiced with a large international firm, both in New York and in Los Angeles, and at another small firm before opening his own firm in 1994. In practice more than 30 years, he has represented individuals, small businesses, and Fortune 500 corporations, handling all manner of commercial disputes including cases involving employment law, intellectual property, entertainment law, real estate, and bankruptcy litigation.

Applying the broad range of his experience in business trial practice, Mr. Markowitz has successfully mediated a wide variety of cases, including contractual, corporate and partnership disputes; intellectual property disputes; employment cases; and even some personal injury matters.

Approach

I tend to be more facilitative than evaluative, but I also believe in doing whatever is likely to work in a particular case. I encourage parties to talk to each other directly if possible, and I also encourage open communication and the exchange of briefs prior to mediation. I think that listening is the essence of mediation. Allowing parties a chance to express and have their concerns heard and appreciated by the other side, is what creates an opportunity for resolution. I believe that the attorneys are an essential part of the process, and I encourage the parties to consider carefully their own attorney’s (as well as opposing counsel’s) evaluations of the case, as the parties’ attorneys.

Fees

Generally $450/hour ($225 per side). Full-day and half-day rates are also available.

Other Information

Joe is a member of the bars of the states of New York and California, and a number of federal courts. He served as chairman of the Legal Committee of the Los Angeles Conservancy, an organization active in historic preservation, and is proud to say that he was instrumental in saving the Cinerama Dome. He participated in a mission to Malaysia and Singapore in 1989, out of which arose a report he co-authored entitled "The Decline in the Rule of Law in Malaysia and Singapore," appearing at 45 The Record of the Association of the Bar of the City of New York 924 (1990) and 46 The Record 5 (1991). He co-authored a report on the Torture Victims Protection Act in 1987, prior to its Congressional enactment. He published an article in the September 2013 issue of Advocate entitled Crisis and Opportunity, as well as an article in the Spring 2008 edition of the ABA Litigation Section ADR committee on the movement to abolish pre-dispute arbitration agreements in consumer transactions.
