Description of Practice

I am an experienced mediator of complex commercial disputes, who has completed extensive mediator training at Harvard Law School and Pepperdine's Straus Institute for Dispute Resolution. For over 25 years, I acted as counsel (for both plaintiffs and defendants) in corporate commercial litigation and class actions and in international and domestic arbitrations. I began my career on Bay Street in Toronto at a leading national firm where I practiced for several years. I later founded my own litigation boutiques, which were peer-recognized by LEXPERT as “repeatedly recommended” for corporate commercial litigation in Toronto. I have been privileged to hold leadership positions in the legal community. I was a founding director of the Canadian Branch of the Chartered Institute of Arbitrators and have served as a director of The Advocates’ Society and on the Executive of the Civil Litigation and Class Action sections of the Ontario Bar Association. The Law Society of Upper Canada and others have invited me to speak on legal ethics and professionalism issues at several programs.

Professional Background

I was called to the Ontario bar in 1994. I am a member of The Law Society of Upper Canada, The Advocates’ Society, Chartered Institute of Arbitrators, American Bar Association

LL.B, Osgoode Hall Law School, Harvard Law School (Certificate in Mediating Disputes, Certificate in Advanced Mediation of Complex Disputes, Certificate in Negotiation and Leadership: Dealing with Difficult People and Problems, Certificate in Negotiating the Impossible) Pepperdine University School of Law (Certificate in Mediating the Litigated Case)

Prior to the mediation, I will convene a conference call with counsel to seek input on how the mediation can best be designed to meet the needs of the parties and the particular case. We will also address any pre-mediation issues. I typically begin the mediation with a joint session of all parties and their representatives. (Counsel do not make opening statements) During this session, I present a PowerPoint I have prepared. It provides an overview of the case and the key facts and the issues in dispute based on my reading of the mediation briefs. I ask the parties and their counsel whether there are any other issues that should be addressed. I then move into caucus sessions with the parties.

My rate for a full day mediation session (6 hours) is $6,000 plus HST. This includes 4 hours of preparation for a PowerPoint presentation of the case that I create and a pre-mediation call (see above). If the mediation sessions exceeds 6 hours, I charge $600 per hour plus HST.
