This video offers an online webinar featuring Craig Nierman, Esq., a mediator, who discusses the psychological and practical considerations of online mediation. Nierman explores how virtual communication differs from in-person interaction, particularly in terms of “Zoom fatigue,” engagement, and trust formation. He provides research-backed solutions for improving virtual meeting effectiveness and offers insights into the unique challenges of online negotiations and mediations, emphasizing the role of emotion and power dynamics. The webinar also highlights the “Will Work For Food” project, which encourages charitable contributions to food banks.
Psychological research has identified ways in which our brains function differently in online communications–and virtual mediation in particular–than they do in person. By understanding and applying the data, we can make be more effective in resolving conflicts through online communication.

His thought leadership is helping to shape the ADR space. The American Bar Association recently published his articles on applying empirical research to negotiating and the psychological issues associated with virtual mediation. The Business Law textbook he co-authored is its third edition.
Craig has taught Insurance and Arbitration at the University of Iowa College of Law, is a member of the Order of the Coif, and serves as the President of the American Academy of ADR Attorneys.
